Employee stole $134,000 from Sudbury company

An employee of a Greater Sudbury scrap metals company who wrote more than five dozen fraudulent invoices totalling more than $134,000 over nearly three years will spend 90 days in jail and have to pay back the money he stole.

“In the circumstances, you find yourself in a very deep predicament,” Ontario Court Justice Heather-Ann Mendes told Norman Dionne, 52, on Friday as she issued a 90-day intermittent jail sentence and a three-year probation order that includes reimbursing Sudbury Iron and Copper a minimum of $500 monthly and the balance owing by the end of the probation order.

“I think you are going to have some time with this intermittent sentence to contemplate your actions.”

Dionne, who was not in custody, had pleaded guilty to one count of fraud over $5,000.

The Crown and defence lawyer Glenn Sandberg suggested the penalties.

Dionne has already come up with $12,000 to go towards restitution.

The court heard that from Jan. 20, 2016 to Sept. 16, 2018, Dionne worked at Sudbury Iron and Copper and used his position to create false invoices in another man’s name for the provision of scrap metal for cash. A total of 65 fraudulent invoices totalling $134,004.83 were involved.

When the fraud came to light, Dionne was fired.

In his sentencing submission, Sandberg said Dionne is currently working and an intermittent jail term will allow him to continue to work.

“It is our hope Mr. Dionne will be able to repay the rest of that loss,” said the lawyer.

Assistant Crown attorney Mathieu Ansell said restitution was important in the case, as it would help make the victim “whole” again.
