Norfolk recognizes new property lines

Harbour Heights subdivision set for new survey

PORT DOVER — Norfolk council flexed a rarely-used power last week to help a developer complete the paperwork on a new subdivision in Port Dover.

July 9, council approved an “exemption of part lot control” to help document the adjusted lots arising from the 38-unit Harbour Heights subdivision under construction on Grand Street. The move also creates a single lot for the construction of a 51-unit apartment building.

The condominium development at issue contains several blocks of joined townhouses.

“This approach is used because of the difficulty the builder would have in ensuring that the common centre wall between two dwelling units was constructed exactly on the property line,” principal planner Mat Vaughan said in his report to council.

“The exemption from part lot control will eliminate the need for individual severance applications for each lot. The street townhouses have already been built and the lots have been surveyed according to the line established between the common walls of each dwelling.”

Put another way, the county is neither creating nor destroying existing lots in the area of Grand Street.

Rather, the county is allowing Harbour Heights Developments of Ohsweken to redraw the property lines where the new homes exist without incurring tens of thousands of dollars in charges with individual applications to the Committee of Adjustment.

Council approved the move during a public meeting under the Planning Act. No member of the public spoke for or against the recommendation. Each unit in the new subdivision will have a separate, unique civic address.
